Beware Troy Lair, The Compliance "Doctor"

I purchased a gastroscope that Troy Lair had listed on DotMed.
The wrong one was sent and he claimed a mix up by UPS. He said he
would find the missing scope and send it overnight as my customer
was waiting for it. I paid $2,000.00 for the scope through
Paypal. A week passed and he did not reply . We finally reached
him and he apologized for the delay and said he would process a
refund because he did not have the scope nor could he find it. My
customer had by now cancelled the order for the scope which
should have arrived originally. Mr. Lair offered to let us keep
the scope sent in error for only $900.00 and we agreed. I asked
him to process a refund for the $2,000.00 and to initiate a money
request for $900.00. The refund was processed but the $2,000.00
did not clear his bank. Paypal tried twice to secure the funds
several days apart after notifying him of the insufficient funds.
No response from Mr. Lair. I sent him the $900.00 but Paypal
returned it to me after the dispute I had initiated was decided
in my favor. My Lair now owes me $1,100.00. He promised to send a
check over night but it never arrived. Now he is completely
unresponsive to emails and telephone calls. My only alternative
is to sue him for the amount due. This was not done through an
EBay listing so there is nothing Paypal can do to force him to
pay up except ban him from Paypal, which they have done. This
company and Mr. Lair are Dotmed certified and have agreed to a
code of ethics and to submit to binding arbitration in the case
of disputes. I am seeking that he submit this matter to binding
arbitration or else be restricted from DotMed and blacklisted.

(read my testimonials on my website, there is clearly two sides
to every story and this one is no different than all the others!)


This Daniel Finerman, VP of Danan Medical Systems, Inc. is a
piece of work.	He has made it practically impossible to resolve
this for he goes and does things to make it impossible.  He
issued a complaint with Paypal for "item not received", when in
fact he did get the scope, a scope that he in return wants to
buy.  He issues the complaint for $2K which is what he paid for
the scope, then offers me $900 for the second scope, mind you he
wants to keep the second and get a $2K refund.	Well, I can't
process this because he has had my paypal blocked and inactivated
because of his deceitful statement of "item not received".  So,
this vendor is one of those vendors that wants his cake and eat
it too.  He wants a full refund but, has not sent me back the
scope that he was sent.  How does that work?  And, he lies to
paypal and then drags your name through the mud when he knows
good and well, he's digging a deeper hole and I very honestly
have too much integrity and credibility than to play games cat
and mouse that they are.  So, he will get his money when i get my

This person calls me a piece of work and deceitful?? I have
complete documentation for all I have written and emails from
"Dr." Lair that corroborate all the trouble we have had with this
credible and honorable person right from the beginning. We
ordered and paid for an Olympus GIF XQ140 which was advertised on
Dotmed. This is how we originally made contact with the good
doctor.
What he sent was an Olympus CF-140L colonoscope which is in no
way similar to what we ordered. He offered to sell us this
mistakenly(?) shipped scope for only $900.00. We tested it and
decided to keep it since for that price it was a good value. I
would have gladly shipped it back to him if he had requested it.
He promised several times to ship the original scope ordered but
was never able to offer a credible explanation as to why it was
never found. At this point I believe he never had it or sold it
earlier.
    I did not make any official complaint until Paypal informed
me that his money refund sent to me for $2000.00 did not clear
his bank 2 times. I had already sent him the $900.00 for the
CF-140L but Paypal returned those funds to me because the
complaint I initiated was decided in my favor. He did not answer
any calls or emails from Paypal and did not ever return the
balance due of $1100.00. Subsequent to this he promised to send a
check overnight for the $1100.00 but it never arrived. He stopped
answering his phone or emails after this and did not return any
phone calls.
I have not heard from him since until he wrote that very
flattering post shown above.
     I think the high finance complexities of these transactions
have escaped the comprehension of the good doctor. But one thing
is for sure. He knows he owes me the money and is just trying to
shift the blame for what he has committed and is resposible for.
If he wants the other scope back I will send it, but then he will
owe me $2000.00, the amount of the origial sale. This item, the
GIF-XQ140 was truly never received.
