Germany-based firm Siemens Healthcare has resolved its pending copyright lawsuit against Conquest Imaging over ultrasound patents.

As part of the settlement, Conquest Imaging has agreed to enter into an injunction that prohibits the company from improperly accessing Siemens' proprietary diagnostic software.

The lawsuit was filed in response to circumvention of security protections around Siemens' proprietary and copyrighted diagnostic software used to maintain Acuson Sequoia ultrasound systems, according to Siemens.
Specifically, the mandates prevent Conquest Imaging from taking the following actions:

-Accessing, using, or copying, or assisting in the accessing, using, or copying, of any of Siemens' proprietary software for any Acuson Sequoia system, including the diagnostic or proprietary software.

-Utilizing or assisting in the utilization of an expired user ID or password to access, use, or copy diagnostic or proprietary software.

-Loading or reloading, or assisting in the loading or reloading, of the diagnostic or proprietary software on any Acuson Sequoia system.

-Purchasing, possessing, making, or utilizing, or assisting in the purchasing, possessing, making, or utilizing, of any method or device to circumvent the user ID or password protections for the diagnostic or proprietary software.

These mandates don't apply to third-party service providers or their customers if they have a valid license to the Acuson system.

"During this lengthy process, we learned a tremendous amount about software, intellectual property and working with the OEMs. We respect the intellectual property of all manufacturers and are conducting business as usual as the leading ultrasound parts, probes, service and training provider," Matt Tomory, vice president of sales, marketing and training at Conquest, told DOTmed News.
